TERMS AND CONDITIONS

1. OVERVIEW
These Terms and Conditions ("Terms") govern your use of the website and online store operated under the name Printhia ("Store", "we", "us", "our"). By accessing or purchasing from our Store, you agree to these Terms.
If you do not agree with these Terms, you may not use our Store.
2. ONLINE STORE TERMS
You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian.
You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Store, violate any laws in your jurisdiction.
You agree not to transmit any viruses or malicious code, or attempt to disrupt the security or operation of the Store.
3. PRODUCTS AND SERVICES
Our main products are 3D printed products and related services. Product images are illustrative; due to the nature of 3D printing, minor visual differences may occur (layering, surface texture, color shade), which are not considered defects.
We reserve the right to:

restrict the sale of our products or services to any person,
-
restrict sales in a specific region or jurisdiction,
-
change product descriptions and prices at any time without prior notice,
-
discontinue the sale of any product at any time.
4. PRICES AND PAYMENTS
All prices displayed in the Store are in the currency shown at checkout and include/exclude taxes as specified at checkout.
We may change prices at any time, but changes will not affect orders already confirmed and paid for.
Payments are processed through payment gateways supported by the Shopify platform. By submitting your payment details, you represent that:

you are authorized to use the chosen payment method,

the information provided is accurate and complete.
5. ORDERS, ACCEPTANCE AND CANCELLATION
Your order constitutes an offer to purchase products from us. We may accept or decline an order at our sole discretion, for example for the following reasons:

product unavailability,
-
obvious pricing errors,
-
suspected fraud.
If we cancel an order after payment has been processed, we will refund the full amount using the original payment method.
Once production of a custom 3D print or made-to-order product has begun, the order generally cannot be cancelled. Any exceptions are entirely at our discretion.
6. SHIPPING AND DELIVERY
Shipping options, costs and estimated delivery times are shown at checkout. These are estimates only and are not guaranteed.
Risk of loss and title to the products pass to you upon handover of the order to the carrier (unless mandatory legal provisions in your country state otherwise).
We are not responsible for:

delays,
-
loss of the shipment,
-
damage caused by the carrier or by circumstances beyond our reasonable control,
but we will assist you in communicating with the carrier and finding a solution where possible.
7. RETURNS, REFUNDS AND 3D PRINT QUALITY
Our Returns and Refunds Policy forms part of these Terms and is available on our website. In the event of a conflict, the Returns and Refunds Policy shall prevail on matters of returns.
In general, given the made-to-order nature of most 3D printed products, returns are typically accepted only in the case of:
-
manufacturing defects,
-
items damaged in transit,
-
items that do not match the agreed specifications (dimensions, model, or color within a reasonable tolerance).
Minor imperfections and visible layer lines typical of 3D printing are not considered defects.
To make a claim, you must:
-
contact us within the period set out in the Returns and Refunds Policy,
-
provide clear photographs and order details.
If the defect is confirmed, we will offer:
-
a replacement,
-
a reprint, or
-
a refund,
in accordance with the Returns and Refunds Policy.
8. USER ACCOUNTS AND PERSONAL DATA
Placing an order may require you to create an account or provide personal data. You are responsible for:

keeping your login details confidential,
-
all activities that take place under your account.
You agree that:

you will provide current, complete and accurate information for all purchases,
-
you will promptly update your details so that we can complete transactions and contact you.
9. INTELLECTUAL PROPERTY AND CUSTOM 3D PRINTING
9.1 OUR CONTENT
All content on the Store, including:

logos,
-
graphics,
-
product photographs,
-
texts,
-
layout and design,
(with the exception of files/models you provide) is owned or licensed by Penev, spol s.r.o. and is protected by applicable intellectual property laws.
You may not:
-
copy,
-
reproduce,
-
distribute,
-
modify,
-
create derivative works
based on our content without our prior written consent.
9.2 CUSTOM MODELS AND MADE-TO-ORDER PRINTING
If you order a print of your own 3D model with us (e.g. by sending a .stl, .obj file, etc.), the following applies:
Customer's responsibility:
-
You represent and warrant that you own all necessary rights, licenses or permissions to use, reproduce and print the file you provide.
-
Full legal responsibility for the origin of the file and the rights to it rests solely with the customer.
Our position:
-
The company Penev, spol s.r.o. does not verify, review or actively investigate the origin (source) of the files you submit.
-
We do not verify whether you hold a license to use them, except where we have reasonable suspicion of a rights infringement.
-
We act solely as a provider of 3D printing services based on your materials.
Right to refuse printing:
We reserve the right to refuse to print any model, in particular if:
-
we have reasonable suspicion that it is a known model protected by a license (e.g. a commercial, film, game or branded model) that prohibits commercial reproduction or manufacture by a third party, or
-
manufacturing it would violate applicable laws, intellectual property rights, or license terms.
License to manufacture:
By submitting a file, you grant us a non-exclusive license to use this content solely for the purposes of:
-
manufacturing (3D printing) your model, and
-
delivering your order.
10. PROHIBITED USE
You may not use the Store or our products:
-
for any unlawful purpose or to solicit others to commit unlawful acts,
-
to violate any international, federal or local regulations, rules or laws,
-
to infringe our intellectual property rights or the rights of others,
-
to submit false or misleading information,
-
to upload malware, malicious code, or attempt to breach security,
-
to interfere with the security features of the Store, the Shopify platform or related services, or to circumvent them.
11. THIRD-PARTY SERVICES AND LINKS
Our Store is hosted on the Shopify platform. Use of the Store may also be subject to Shopify's own terms and policies.
Content, products or services available through our Store may include:

third-party materials,

links to third-party websites.
We are not responsible for:

examining or evaluating the content or accuracy of third-party materials,

any warranties or liability for such third-party materials or websites.
12. DISCLAIMER OF WARRANTIES
The Store and all products and services delivered through the Store are provided "as is" and "as available" unless expressly stated otherwise.
We do not warrant that the Store will be:

uninterrupted,

timely,

secure,
-
error-free,
nor that errors will be corrected immediately.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

warranties of merchantability,

fitness for a particular purpose,

non-infringement of third-party rights.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
The company Penev, spol s.r.o. , its owners, employees and affiliated entities shall not be liable for any:

indirect,

incidental,
-
special,
-
consequential,
-
punitive damages,
including loss of profit, loss of revenue, loss of savings, loss of data, or the cost of substitute goods, arising in connection with the use of the Store or the products purchased.
Our total aggregate liability for any claim relating to the Store or the products shall not exceed the amountyou paid for the specific order that gave rise to the claim.
Some jurisdictions do not allow the limitation of certain damages; in such cases, our liability will be limited to the minimum extent permitted by applicable law.
14. INDEMNIFICATION
You agree to indemnify, defend and hold harmless the company Penev, spol s.r.o. , its owners, employees and affiliated entities from any claim or demand (including reasonable legal fees) made by any third party arising out of or in connection with:

your breach of these Terms,

your violation of any law,

your infringement of the rights of a third party.
15. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and any separate agreements under which we provide you products or services are governed by the law of the jurisdiction in which the company Penev, spol s.r.o. is legally established (unless mandatory consumer law in your country provides otherwise).
Disputes arising from or in connection with these Terms shall be:

resolved before the competent courts of that jurisdiction,
unless mandatory law grants you the right to bring a claim before your local courts.
16. CHANGES TO THE TERMS AND CONDITIONS
We reserve the right to:

any part of these Terms by posting updates on this page. The "Last updated" date will be revised accordingly.
It is your responsibility to check this page periodically. Your continued use of the Store after changes are posted constitutes acceptance of those changes.
